Nathan R. White is an associate in Prince Yeates’s litigation section.
Business and Commercial Litigation and Arbitration
Mr. White has a wealth of experience dealing with nearly every kind of business and commercial dispute, including shareholder derivative litigation against corporate officers and directors, breach of contract actions, trade secret disputes, corporation and LLC dissolution issues, claims against professionals including attorneys, accountants, and medical professionals, commercial arbitrations subject to American Arbitration Association (AAA) rules, and claims for insurance proceeds and wrongful denial of insurance coverage.
Mr. White is a skilled appellate lawyer and is experienced in every stage of the appeals process, including briefing, oral argument, and certiorari. He also specializes in post-trial and post-judgment motion practice at the district court level with an eye toward future appeals.
Government and Administrative Law
Mr. White’s experience as a former government lawyer gives him a unique understanding of the challenges individuals and businesses face when dealing with federal, state, and local government actions. He has experience advising organizations regarding audits and defending against administrative enforcement actions by federal and state government agencies, including the United States Department of Labor, United States Department of Health and Human Services Office of Civil Rights, the Equal Employment Opportunity Commission (EEOC), and the State of Utah, Department of Workforce Services. Mr. White also has expertise navigating the administrative rulemaking process on both the federal and state levels.
Mr. White has a wealth of employment law experience as former legal counsel for the State of Utah, Department of Workforce Services. He specializes in defending against claims for unemployment tax contributions as well as handling unemployment insurance claims for both employers and claimants. In addition, he has both litigation and compliance experience related to employment discrimination and Family Medical Leave Act (FMLA) claims.
Probate, Trust, and Estate Litigation
Mr. White has experience litigating every type of probate, trust, and estate dispute, including disputes between beneficiaries, claims against trustees and personal representatives, suits for accounting of trust and estate assets, and actions to interpret will and trust provisions.
Mr. White has litigated multiple major condominium and HOA disputes to successful resolutions. He has represented individual unit and homeowners, commercial tenants, and homeowners’ associations in condominium and HOA disputes both large and small.
Personal Injury/Products Liability/Premises Liability
Mr. White has a great deal of experience handling personal injury claims for both plaintiffs and defendants and has tried, arbitrated, or settled hundreds of cases. He has particular expertise in cases involving motor vehicle accidents, bicycle accidents, auto-pedestrian accidents, product defects and failures, and premises liability (slip and fall). Mr. White’s premises liability experience also includes issues related to compliance with the Americans with Disabilities Act (ADA).
Mr. White has represented individuals and businesses in relation to claims brought under federal and state consumer-protection statutes, including the Fair Debt Collection Practices Act (FDCPA), FTC Act, Utah Consumer Sales Practices Act, and Utah Pattern of Unlawful Activity Act. He has also provided compliance services for organizations that are subject to the FDCPA and the FTC Act, including FTC Franchise Disclosure Document compliance for franchisors.
Health Law – Medical Privacy and Data Security
Mr. White specializes in providing compliance services to covered entities and business associates subject to HIPAA, the HITECH Act, and 42 C.F.R. Part 2, including drafting of business associate agreements and notices of privacy practices. His experience also includes advising clients on HIPAA breach notification and reporting.
