Mr. Boevers’ practice is concentrated on civil litigation. His work focuses on complex motion practice and appeals.
Mr. Boevers has represented both plaintiffs and defendants in the state and federal courts of Utah and other states, in the United States Courts of Appeal for the Ninth and Tenth Circuits, in the United States Tax and Bankruptcy Courts and before state and federal administrative agencies.
He has handled a wide variety of commercial, personal, environmental, and real estate claims. He has counseled health and welfare benefit plans on ERISA issues.
Recently, Mr. Boevers and another shareholder in Prince Yeates, Mike Zundel won an appeal in the Utah Court of Appeals. The court affirmed a d judgment of over $1,000,000 for their client (including attorney fees) based on the opposing party’s contempt of court (refusal to obey a court order to sell some real estate to their client). The court of appeals also awarded their client attorney fees incurred on appeal. At Mr. Boevers’ and Mr. Zundel’s request, the lower court required the opposing party to post a property bond (real estate) to secure the judgment and the real estate appears to be worth at least the amount of the judgment.
